These Terms and Conditions outline the responsibilities and limitations of GENE SENSE and its practitioner, Dr. Lindie Schloms (PhD), regarding the services provided. By using our services, you acknowledge and agree to the following:
1. Nature of Services:
GENE SENSE provides personalised health insights and recommendations based on 3X4 Genetic testing results. These insights may include diet, lifestyle, and supplement guidance tailored to your genetic profile.
2. Qualifications:
Dr. Lindie Schloms holds a PhD in Biochemistry and is a certified 3X4 Genetics practitioner. However, Dr. Schloms is not a medical doctor and does not diagnose, treat, or cure any medical conditions.
3. Scope of Recommendations:
The recommendations provided by GENE SENSE are:
* Based on genetic data and general scientific knowledge.
* Intended to support your overall well-being.
* Not a substitute for medical advice, diagnosis, or treatment from a qualified healthcare provider.
It remains your responsibility to consult with a licensed healthcare professional before making any significant changes to your diet, lifestyle, or supplement regimen.
4. Limitations of Liability:
GENE SENSE and Dr. Lindie Schloms are not liable for:
* Any adverse effects, injuries, or damages resulting from the use or misuse of recommendations provided.
* Any outcomes or results not meeting your expectations.
* The accuracy or completeness of genetic data provided by 3X4 Genetics, as GENE SENSE acts as a facilitator for the testing service.
5. Informed Consent:
By proceeding with the 3X4 Genetic testing and related services, you confirm that you:
* Understand the nature and purpose of the genetic testing and recommendations.
* Have been informed of the qualifications and scope of practice of Dr. Lindie Schloms.
* Accept full responsibility for any decisions made based on the provided insights.
6. Confidentiality:
GENE SENSE is committed to maintaining the confidentiality of your personal and genetic information. All data will be handled in accordance with applicable privacy laws and will not be shared without your explicit consent.
7. Payment and Refund Policy:
Payment for the 3X4 Genetic testing and consultation services must be made in full before testing commences.
Once the genetic testing process has started, no refunds will be provided.
8. POPIA Compliance (Protection of Personal Information Act, South Africa):
GENE SENSE is committed to protecting your personal information in accordance with the Protection of Personal Information Act, 4 of 2013 (“POPIA”). By proceeding with the 3X4 Genetic testing and related services, you acknowledge and consent to the collection, use, and processing of your personal information, including special personal information such as health-related data and genetic test results. This information may include your contact details, health history and lifestyle information you provide, genetic reports from 3X4 Genetics, consultation notes, and personalised recommendations. Your information will only be processed for purposes related to delivering the services you requested, including facilitating testing, interpreting results, providing personalised guidance, communicating with you, and maintaining appropriate records. GENE SENSE will not sell your information or share it with third parties for marketing purposes, and will only share information where necessary to deliver the service (e.g. with 3X4 Genetics or relevant service providers) or where required by law. Reasonable security measures are implemented to protect your information from unauthorised access, loss, or misuse, and your information will be retained only for as long as necessary for service delivery and legal or professional record-keeping requirements. You have the right to request access to your information, request corrections, object to certain processing, and withdraw consent in writing (noting that withdrawal may limit GENE SENSE’s ability to continue providing services).
